Service agreement governing your use of our website and cleaning services.
Acceptance of Agreement
SparkTex Cleaners ("SparkTex," "we," "us," or "our") operates sparktexcleaners.com (the "Site") and provides residential and commercial cleaning services (the "Services"). By accessing the Site or engaging our Services, you agree to comply with and be bound by these Terms of Use. If you do not agree with any part of these Terms, you must not use our Site or Services.
Booking & Cancellations
All bookings require a deposit and are subject to our cancellation policy:
- A $90.00 non-refundable deposit is required to confirm all appointments, which is credited toward your final invoice.
- A minimum of 24 hours' notice is required for cancellation or rescheduling; failure to provide notice forfeits the $90.00 deposit.
- Lock-Out Clause: If our team cannot gain access to the property due to locked gates, missing keys, changed access codes, or aggressive pets, a full $90.00 cancellation fee will be charged.
Deposit Policy: The $90.00 deposit is non-refundable and secures your appointment slot. It is applied as a credit toward your final service invoice.
Payment Terms
Payment is due immediately upon receipt of invoice, with the following terms:
- A strict 48-hour grace period applies from the date of invoice.
- Late fee: 5% of the total balance or $25.00, whichever is greater. Interest may accrue at the maximum rate permitted by Texas law.
- Client agrees to pay all collection fees, legal fees, and court costs if collection proceedings become necessary.
Late Payment: Invoices not paid within 48 hours are subject to a 5% late fee or $25.00 minimum, plus interest at the maximum rate allowed under Texas law.
Scope of Service
Our cleaning services are subject to the following operational limitations:
- Height Limit: Staff will not climb higher than a two-step ladder.
- Weight Limit: Staff will not move items exceeding 35 pounds; no heavy appliances.
- Climate Control: Only temperature-controlled living spaces are cleaned (no attics, garages, or porches in extreme heat or cold conditions).
- Clutter: Our services are for cleaning, not organizing. A "Heavy Duty" surcharge of $20/hour applies to excessively cluttered spaces.
Client Responsibilities
To ensure a safe and efficient cleaning experience, clients must:
- Secure all pets in a separate room or area prior to the scheduled appointment.
- Ensure water and electricity access throughout the property.
- Deactivate or provide alarm system codes before service begins.
SparkTex Cleaners is not liable for alarm dispatch fees resulting from unreported or improperly deactivated alarm systems.
Health & Biohazards
Our staff is strictly prohibited from handling biohazardous materials, including but not limited to:
- Feces, urine, vomit, or blood
- Black mold or pest infestations
- Hazardous chemicals, sharps, or needles
Important: If biohazardous conditions are encountered, our team will stop service immediately. A full cancellation fee may apply, and the client will be responsible for the balance of work already completed.
Damages & Liability
Claims for damage must follow these procedures:
- All damage must be reported in writing within 24 hours of service completion; claims submitted after this window are void.
- SparkTex Cleaners is not liable for damage resulting from normal wear and tear, improper installation, or undisclosed items of extreme value.
Liability Cap: Our total liability is limited to the amount paid for the specific service during which damage occurred, or the actual cost of repair, whichever is less.
Non-Solicitation
The client may not directly hire, employ, or contract any SparkTex Cleaners employee or contractor for cleaning or related services.
Referral & Training Fee: A $2,500.00 fee applies if this provision is breached within 12 months of the employee's last service visit.
Satisfaction Guarantee
SparkTex Cleaners does not issue cash refunds. If you are not satisfied with any aspect of our service, you must notify us within 24 hours. Our sole remedy is a complimentary re-clean of the affected areas at no additional cost.
Failure to allow the re-clean waives your right to any remedy.
Intellectual Property
All content on this website — including text, graphics, logos, images, and software — is the property of SparkTex Cleaners and is protected by applicable copyright laws. The SparkTex name and logo are trademarks. Unauthorized reproduction, distribution, or use of any material on this Site is strictly prohibited.
Indemnification
The client agrees to indemnify, defend, and hold harmless SparkTex Cleaners, its officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of our Services, your violation of these Terms, or your violation of any rights of a third party.
Dispute Resolution
These Terms are governed by the laws of the State of Texas. Any disputes arising from or relating to these Terms or our Services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in Montgomery County, Texas (or Harris County at SparkTex's discretion).
Class Action Waiver: All claims must be brought in the parties' individual capacity, not as a plaintiff or class member in any purported class or representative proceeding.
Force Majeure
SparkTex Cleaners shall not be held liable for any delay or failure in performance resulting from acts of God, severe weather events, war, terrorism, riots, embargoes, fire, accidents, or any other circumstances beyond our reasonable control.
